
The Bombay High Court has denied the pre-arrest bail request of a Mumbai developer accused of defrauding a doctor of Rs 90 lakh in exchange for a flat in his Parsi Colony project in Wadala. The court expressed concern that there may be other victims involved. Justice N J Jamadar criticized the developer for making the innocent investor wait for ten years, calling his conduct dishonest. The investor had invested in the Neumac Aura project after being misled by the developer, only to find no progress at the site when visiting. Despite promises of a refund, the developer failed to follow through and even issued threats. Legal proceedings have been initiated against the developer for breach of trust, cheating, and intimidation. The court scrutinized the developer's claims, debunking his excuses related to project delays and contractual breaches. The court emphasized the need to determine the developer's intentions since the project's inception and refuted claims of the BMC halting the project. Construction progress was found to be inadequate, contradicting the developer's assertions.The updated target completion date is now June 30, 2024. Justice Jamadar emphasized the importance of recognizing the element of dishonest intent in light of these factors. He remarked that Jain attempted to shift blame to others for the delay and applied for pre-arrest bail based on an alleged intent to deceive. The judge deemed that Jain's arrest and questioning are essential.
